General Terms and Conditions – Careers Service of Lucerne University of Applied Arts and Sciences
(This is a translation of the German original. The German version shall always prevail in case of doubt.)
Purpose
The Careers Service of Lucerne University of Applied Arts and Sciences (referred to hereinafter as Careers Service HSLU) offers products and services in the areas of campus recruiting, personnel marketing and sponsorship in order to put students and companies in contact with each other. These provisions apply in conjunction with the delivery of these products and services for the following groups:
• Students
• Customers (such as private or public companies and authorities)
Where both groups are addressed, they are referred to as “users”.
- Application
These General Terms and Conditions come into effect between Careers Service Lucerne HSLU and its users. Deviating provisions are only valid if they have been expressly recognised in writing by Careers Service HSLU. Careers Service HSLU serves customers based in Switzerland.
- Contract conclusion and implementation
The user selects the services to be provided by Careers Service HSLU from the range of services available at the time of placing the order. The contract in question comes into effect when Careers Service HSLU confirms the contract or partnership in writing, or the offer is published (advertisement, event, company portrait, etc.) on the internet or an online platform (careershslu.ch). The requirement of the written form is met by sending an e-mail. In the case of insertions, the contract comes into effect when the offer is published. A new contract is concluded for each service offer or insertion. The contract comes into effect with the General Terms and Conditions applicable at contract conclusion. The customer is not affected by any changes to the General Terms and Conditions made by Careers Service HSLU during the contract term.
- Early contract termination
The contract term is based on the specifications contained in the service schedule or is agreed on individually with the user. Careers Service HSLU reserves the right to delete an offer at any time without prior notice, without consequential costs or damages and without having to state reasons. The user does not have recourse to legal action. In particular, deletion will occur if Careers Service HSLU has reservations regarding the content or context. If damages are incurred to Careers Service HSLU as a result, it has recourse to the user.
- Disclaimer
The liability of Careers Service HSLU is limited to intent and gross negligence. Liability for secondary damages is ruled out. The Careers Service is not responsible for the accuracy of the content communicated by users through Careers Service offers placed on a website or onlineplatform. The services of Careers Service HSLU are provided via the open internet or on a password-protected platform. For this reason, Careers Service HSLU cannot accept any responsibility for the uninterrupted availability and correctness of its services. The non-appearance of an advertisement of offer or its placement in a different position on the website or the Careers Service HSLU online platform do not entitle users to assert claims for damages.
- Content of customer advertisements and other offers
The customer is solely responsible for the content of their advertisements. The customer undertakes to publish only legally admissible advertisements via Careers Service HSLU and in particular to refrain from publishing advertisements which are racist, pornographic or slanderous. The customer confirms that their advertisement or offer is ethical, morally decent and legally correct. Careers Service HSLU reserves the right not to place advertisements or offers, without forewarning or reason if they do not meet these requirements and to delete them without stating reasons and without consequential costs or damages. By placing an order, the customer consents to the publication of their advertisements and offers on the internet and on the Careers Service HSLU online platform.
- Data protection
Customers can use the online platform (careershslu.ch) to view students’ personal details if the latter have released their data. Customers are obliged to treat the user name and passwords assigned to them to access the profile database in confidence and to ensure that these are only made accessible to authorised persons within the company. The customer may only use the personal details for the agreed purpose, i.e. to recruit interested job seekers. Customers are liable for damages if the user names and passwords assigned to them are misused. They are not permitted to share personal details with others without the consent of the individual concerned. The interested student who opts for full or partial release of their data agrees to their details being viewed by users who have password access to the system.
Registration of students for Careers Service offers
Registration is by means of log-in (www.careershslu.ch). Students are required to save a profile in order to sign up for an event.
Students decide for themselves whether and which details are visible to customers. Students are responsible themselves for releasing their data and for the information it contains.
Students cannot view the profiles of other students.
Responsibility for managing the data and data content
Responsibility for managing data (such as posting and updating data), account content and profiles lies solely with the user.
8.1. Data deletion Data and the account itself can be deactivated or deleted at any time. This can be carried out by users themselves or by the Careers Service on notification.
- Performance of the service
Lucerne HSLU reserves the right to involve third parties in the performance of services or have services performed by third parties. The performance of services is carried out within the framework of existing capacities. Lucerne HSLU is entitled to temporarily suspend, postpone or cancel services for important reasons (industrial action, force majeure, stoppage on the part of executing third parties). In the event of full or partial suspension of the service, the contract is valid for the altered term if the customer does not object in writing within a period of 14 days.
- Venue regulations in the case of events held at Lucerne HSLU Users undertake to observe the house rules and any other venue regulations.
- Price
The price is based on the information provided in the service schedule.
- Methods of payment
HSLU invoices issued on behalf of Careers Service HSLU are due for payment within 30 days. Debtors of Careers Service HSLU are immediately in default at the end of the 30-day period after the invoice is issued. From this point in time, the Careers Service is entitled to withdraw from the contract without granting an extension and to discontinue its services.
- Kontaktgespräch
13.1. General
Kontaktgespräch ist a Lucerne HSLU event. It is organised and implemented by the Lucerne HSLU Careers Service. During the event meetings occur between interested companies (referred to hereinafter as customers) and Lucerne HSLU students. Registered companies are given online access to graduate profiles in advance of the event in cases where the students have released their data for viewing by companies. Students can also apply to companies for an interview in cases where companies wish this to happen. During the event, registered companies have the opportunity to present themselves at a stand.
13.2. Contract conclusion
The sign-up for Kontaktgespräch is via registration on the online platform (www.hslu.ch/careers). The contract comes into effect on confirmation of sign-up by the Careers Service.
13.3. Admission of companies
Face-to-face meetings are primarily open to companies who wish to promote themselves as employers of students and who have concrete vacancies to fill.
13.4. Prices
The prices shown online are binding, as are written offers and the prices in the confirmation.
13.5. Withdrawal from the contract
If the customer withdraws from the contract 20 days before the start of the face-to-face meeting, a fee of CHF 250.– is charged to cover costs. In the customer withdraws later than this, the full participation fee is due. Withdrawals are only accepted in writing.
13.6. Order of acceptance of customers
Companies can reserve a stand for themselves via the online platform. The final decision as to stand allocation is taken by the Careers Service.
13.7. Insurance and safety
Insurance cover is the responsibility of the customer. Customers are responsible for safety at their stand and in the spaces assigned to them.
13.8. Stand design
Customers can be provided with a table/tables, seating and partition walls (at an extra charge) for free configuration by advance order. The Careers Service can ask for the elimination of display items and the discontinuation of activities if these disturb the event due to noise, smell or other emissions.
The sale of products to persons is not permitted. Sale in this sense also applies to the receipt of a purchase obligation, even if the delivery or payment of the order occurs at a later time directly or via a sales outlet. Express approval is required for any exception to this ruling. Samples may only be handed out free of charge.
Surveys and the distribution of brochures, leaflets, samples and the like are only permitted at the company's own stand. Express approval on the part of Lucerne University of Applied Sciences and Arts is required for any exception to this ruling. In the event of violations, Lucerne HSLU is entitled to close the stand without it being possible to derive any claims against Lucerne HSLU as a result.
- Disclaimer
Lucerne HSLU rules out any liability to the extent permitted by law.
- Final provision
Careers Service HSLU reserves the right to alter these conditions of use at any time. Users will be informed of the alterations in an appropriate manner. Swiss law shall be exclusively applicable.
